The Danger of Bill of Exchange Proceedings

Promissory Notes (Bono) and Checks allow creditors to initiate “Specific Proceedings for Bills of Exchange” (Kambiyo Senetlerine Özgü Takip).

  • This is much faster and harsher than normal procedures.
  • Attachment (Foreclosure) can start in 10 days.

The Problem: “This Signature is Not Mine!”

Sometimes, fraudsters forge a signature on a blank note or a person finds themselves facing a debt they never signed for.

If you receive a Payment Order (Sample 10) involving a note with a fake signature, YOU MUST ACT FAST.

1. The 5-Day Deadline (Critical)

Unlike the 7-day rule for normal debts, objections for Bills of Exchange must be made within 5 DAYS.

  • Where: Not to the Execution Office! You must file a lawsuit in the Enforcement Civil Court (İcra Hukuk Mahkemesi).
  • Action: “Objection to Signature” (İmzaya İtiraz).

Warning: Simply petitioning the execution office IS USELESS. You must file a formal lawsuit.

2. The Process

  1. Filing: We file the petition requesting a “Suspension of Execution” (court may require security).
  2. Hearing: The judge summons both parties.
  3. Forensic Exam: The judge obtains signature samples from you (standing, sitting, fast, slow) and sends them to the Forensic Medicine Institute (Adli Tıp) alongside documents containing your signature from official institutions (Banks, Tapu, Notary).
  4. Report: Experts examine the pressure, angle, and flow to determine if the signature is yours.

3. The Consequences

If You Win (Signature is Fake):

  • The proceeding is CANCELLED.
  • The creditor is ordered to pay you 20% Bad Faith Compensation.
  • You can essentially use this verdict to file a criminal complaint for “Official Document Forgery” (Resmi Evrakta Sahtecilik), which carries heavy prison sentences.

If You Lose (Signature is Yours):

  • The proceeding continues.
  • You are fined 20% Denial Compensation.
  • You must pay an additional 10% Fine.

Important Tip

Do not file this objection just to gain time. Forensic science is very advanced and will almost certainly identify if the signature is yours. Only file if you are sure it is forged.
