With recent amendments to the Execution and Bankruptcy Law, seizing items necessary for the debtor and their family to sustain their life has been PROHIBITED. The saying “Home attachment is abolished” comes from here. Attachment is not abolished, but its scope is hollowed out.
1. Non-Seizable Goods (Necessary Goods)
Found in the debtor’s home;
- Fridge, Washing Machine, Dishwasher, Oven.
- Sofa Set, Bed, Carpet, Curtain.
- Television (if 1), Computer (if for Student/Work). These are considered “Necessary Goods” and cannot be seized.
2. What Can Be Seized?
- Money, Gold, Jewelry: Cash and jewelry found at home.
- Antiques: High-value art pieces.
- Excess (Duplicate) Goods: If there are 2 TVs, one can be seized; if 2 fridges, one can be seized.
3. Pension Attachment
Pension (SGK) cannot be attached without the debtor’s consent. If the execution office places it by mistake, it is removed via complaint. (Except alimony debts).
