What is “Execution Without Judgment”?

In Turkey, a creditor does not always need a court verdict to start legal action against you. They can initiate an “Execution Proceeding Without Judgment” (İlamsız Takip) directly through the Execution Office.

The Execution Office sends you a Payment Order (Ödeme Emri - Sample No. 7). It basically says: “Person X claims you owe them 10,000 TL. Pay it in 7 days or object.”

The Golden Rule: The 7-Day Deadline

The most critical thing to know is that you have 7 DAYS from the moment you receive the notification.

If You Object Within 7 Days:

  • The execution proceeding STOPS AUTOMATICALLY.
  • The creditor cannot seize your salary, home, or bank accounts.
  • To restart the process, the creditor must file a lawsuit (Cancellation of Objection Action) and prove the debt in court.

If You Do NOT Object:

  • The proceeding becomes FINAL.
  • You are now legally considered a debtor (even if you owed nothing!).
  • The creditor can immediately send attachment writs to your banks and employer.

How to Object?

  1. Go to the Office: Visit the Execution Office that sent the order.
  2. Submit Petition: Write a simple petition stating: “I object to the debt, the interest, and the signature. I have no debt to this creditor.”
  3. No Fee: Objecting to the debt is free of charge.

Types of Objection

Objection to Debt (Borca İtiraz)

Use this if you claim you don’t owe the money, or you already paid it.

  • “I have no relation with this creditor.”
  • “I paid this debt via bank transfer previously.”

Objection to Jurisdiction (Yetkiye İtiraz)

If the creditor filed the proceeding in a wrong city (e.g., you live in Istanbul, they filed in Ankara).

  • You must state this explicitly: “I object to the authority of Ankara Execution Offices. Istanbul is authorized.”

Partial Objection

You can accept part of the debt but object to the rest (e.g., exorbitant interest).

  • Warning: You must specify the amount clearly: “I accept 5,000 TL principal, but object to the 2,000 TL interest.”
  • If you don’t specify, you are deemed to have accepted the whole debt.
