“Home Foreclosure is Abolished” Myth

There is a widespread misconception in Turkey that “Foreclosure coming to the house is completely banned.” This is false.

Execution officers CAN still come to the debtor’s home, inspect it, and seize specific items. However, the scope of what they can take has been drastically reduced by recent amendments to Article 82.

The “Necessary Goods” Protection

The law now strictly prohibits the seizure of “goods necessary for the debtor and their family to sustain their lives.”

Items That CANNOT Be Seized (Protected)

Unless there are two of them, you cannot seize:

  • White Goods: Refrigerator, Washing Machine, Dishwasher, Oven.
  • Furniture: Sofa sets, beds, wardrobes, dining tables.
  • Electronics: 1 Television, Computers used for education/work, mobile phones (debated, usually protected if personal).
  • Kitchenware: Pots, pans, cutlery.

Basically, if taking it would make the house unlivable, it cannot be taken.

Items That CAN Be Seized

The protection applies to necessities, not luxuries or surplus.

1. Surplus Goods (Duplicates)

If the house has two washing machines or two Televisions:

  • The officer leaves one for the family.
  • Seizes the other one.

2. Luxury Goods

  • Antiques.
  • High-value paintings or artwork.
  • Expensive sound systems (if deemed non-essential).

3. Cash and Valuables (The Real Target)

The officer primarily looks for:

  • Cash Money in the house.
  • Gold, Jewelry, Watches.
  • These are never “necessary goods” and are seized immediately.

The Procedure at the Door

  1. Arrival: The Execution Officer (Memur) arrives, usually with the creditor’s Attorney.
  2. Entry: If you invite them in, they enter. If you refuse or are not home, they have the authority to call a Locksmith and Police to force entry legally.
  3. Inventory: They look around, write down items.
  4. Seizure: If they find cash/gold or luxury items, they confiscate them. If they only find standard furniture, they write a “Non-Seizability Minutes” (Haczi Kabil Mal Bulunamadı) and leave.
