When a relative passes away, saying “I am an heir” is not enough for you to claim rights on their assets (Withdrawing money from bank, taking house onto you). You must prove this with an official document given by the state. This document is called Certificate of Inheritance.

1. Where to Obtain?

A) From Notary (Easiest Way)

If there is no confusion in heirship status (If population records are proper), you can get your document within the same day (takes 15 minutes) by going to any notary.

  • Not all heirs need to go. It is sufficient for one heir to apply.

B) From Civil Court of Peace

In the following cases, Notary does not give document, directs you to Court:

  • If one of the heirs is foreign national.
  • If there is conflict in population records.
  • If there is a will. In this case, petition is submitted to Civil Court of Peace. Court process takes between 1 week to 1 month.

2. Can It Be Obtained from E-Government?

Yes. If a certificate of inheritance was issued for that person before (after 2018) or notary processed it to system, you can get free barcoded document by saying “Certificate of Inheritance Inquiry” on E-Government. However, if it will be issued for the first time, it cannot be obtained from e-government.

3. What Does Certificate of Inheritance Do?

This document does not mean inheritance is shared. It only shows who the heirs are and share rates (Shares).

  • MANDATORY for:
  • Making transfer in title deed,
  • Asking and withdrawing money in bank,
  • Submitting inheritance tax return to tax office.

Frequently Asked Questions

Q: Is obtaining certificate of inheritance accepting debts? A: Yes, it is an indication that you indirectly claimed inheritance (with debts). If you suspect inheritance is insolvent, it might be more correct to file “Determination of Estate” lawsuit before getting the document.
