1. The TFF Arbitration Board (Tahkim Kurulu)

For football-related disputes in Turkey (e.g., a player claiming unpaid wages from Galatasaray or Fenerbahçe), the primary authority is the Turkish Football Federation (TFF) Arbitration Board.

  • Jurisdiction: Disciplinary sanctions (Red cards, stadium bans) and Contractual disputes (Wages, terminations).
  • Binding Nature: As mentioned, these decisions are final within the domestic legal order.

2. CAS (Court of Arbitration for Sport)

Based in Lausanne, Switzerland, CAS is the “Supreme Court of Sports.”

  • International Disputes: If a dispute involves a foreign player and a Turkish club, the contract usually allows recourse to FIFA’s Dispute Resolution Chamber (DRC) and then to CAS.
  • Doping: Appeals against anti-doping violations are almost always heard by CAS.

Common Dispute Types

  1. Unpaid Wages: The most common issue. In Turkey, if a club fails to pay, the player can terminate the contract for “Just Cause” (FIFA RSTP Art. 14bis).
  2. Unfair Termination: If a club fires a player without valid reason, they must pay the residual value of the contract.
  3. Training Compensation: Payments due to the academies that trained a young player when he signs his first pro contract.

The Process

  1. Notice of Default: Before filing a case, you must send a formal notice (Notary Warning) giving the club a deadline to pay.
  2. Submission: Filing the claim with TFF or FIFA.
  3. Defense & Rejoinder: Exchange of written arguments.
  4. Award: The tribunal issues a binding monetary award.
