The concept of “Tort” (Haksız Fiil) is the foundation of almost all non-contractual compensation claims in Turkey. Whether you were hit by a car, injured in a work accident, or defamed on social media, your legal remedy lies in Article 49 of the Turkish Code of Obligations (TBK).

Foreign clients (especially from the USA) often expect multimillion-dollar payouts for “Mental Anguish.” In Turkish Law, Moral Compensation (Manevi Tazminat) is NOT a tool for enrichment or punishment. It is merely a “spiritual consolation.” Judges rarely award massive sums, aiming instead to balance the parties without bankrupting the defendant.

1. The 4 Elements of Liability

To win a compensation lawsuit, you must prove four distinct elements. If one is missing, you get nothing.

  1. Unlawful Act: The action must violate the law (e.g., running a red light, punching someone).
  2. Damage: You must have suffered actual loss (broken leg, smashed car, lost wages).
  3. Fault (Kusur): The perpetrator must be negligent or intentional.
  4. Causal Link: Your damage must be the direct result of that act.

2. Types of Compensation

A) Material Compensation (Maddi Tazminat)

  • Loss of Earnings: Wages lost while recovering.
  • Loss of Body Integrity: If you have permanent disability (e.g., 10% loss of arm function), an actuary calculates your lost lifetime income.

B) Moral Compensation (Manevi Tazminat)

This is for pain, suffering, and emotional distress.

  • It is subjective. The judge decides the amount based on “Social and Economic Status” of parties.

3. Statute of Limitations (Zamanaşımı)

Generally, you must file the lawsuit within 2 Years of learning about the damage and the perpetrator. The absolute limit is 10 Years from the act.

  • Exception: If the act is also a crime (e.g., Traffic Injury/Assault), the longer “Criminal Statute of Limitations” (often 8 years) applies.
