“No Pay, No Play?”

In professional football, financial disputes are common. If a club fails to pay the player, can the player leave immediately? No. There is a strict legal procedure.

The Process (TFF & FIFA)

  1. Default: The club misses a payment (Salary, Match Fee, Sign-on Fee).
  2. Determining the Debt: The debt must be “due and payable”.
  3. Warning (Notice): The player must send a Notary Warning (Ihtarname) giving the club at least 15 Days (under TFF rules) to pay.
  4. Termination: If payment is not made within 15 days, the player sends a “Termination Notice”.

The Consequences

  • Free Agent: The player becomes free to sign with another club immediately.
  • Compensation: The player can claim:
    • All unpaid past salaries.
    • Residual Value: The value of the contract for the remaining years (often mitigated if he finds a new club).
    • Sporting Sanctions: The club may face a transfer ban.

Common Mistakes

  • Terminating without the 15-day notice. (Player pays compensation!)
  • Accepting “partial payment” that resets the clock.
  • Signing “Release” documents (Ibraname) under pressure.
