Electronic Seizure (E-Haciz) on Bank Accounts: How to Lift It?

What is E-Haciz?

The Tax Office (or SGK) can electronically block your bank accounts without sending a simultaneous paper notice. You usually discover it when your card is declined at a market.

Is It Legal?

Yes, under Law No. 6183, broadly speaking. BUT, they must follow a procedure:

1. Payment Order (Ödeme Emri): They must first notify you of the debt.
2. 7 Days: You have 7 days to pay or object.
3. Seizure: If you do nothing, they apply E-Haciz. If you never received the Payment Order (e.g., sent to a wrong old address), the E-Haciz is ILLEGAL.

What Can They Seize?

• Bank Balances: Yes.
• Salary: Only 1/4th of your salary can be seized. If they block the entire salary account, it is unlawful.
• Pension: Generally protected (except for SGK debts/Alimony).

How to Lift E-Haciz?

1. Pay the Debt: The fastest way.
2. Installments (Taksitlendirme): Apply to the Tax Office to pay in 36 months + Interest. They usually lift the block if you pay the first installment.
3. Lawsuit: If the notification was wrong or the debt expired (Statute of Limitations - 5 Years), we file a case in Tax Court to cancel both the Payment Order and the E-Haciz.
