The “7-Day Defense” Rule

Under Law No. 657, a civil servant CANNOT be punished without being asked for their defense.

  • You must be given at least 7 Days to submit your written defense.
  • If they punish you without this, the penalty is Automatically Void (Procedural Error).

Types of Penalties (DMK 125)

  1. Warning (Uyarma): “Be more careful.” (e.g., Coming to work late).
  2. Reprimand (Kınama): “Your behavior is flawed.” (e.g., Disrespecting a supervisor).
  3. Salary Cut (Aylıktan Kesme): 1/30 to 1/8 of salary deducted. (e.g., Unauthorized absence for 1-2 days).
  4. Stopping Progress (Kademe İlerlemesinin Durdurulması): Promotion frozen for 1-3 years. (e.g., Drunkenness on duty).
  5. Dismissal (Devlet Memurluğundan Çıkarma): Fired and banned from public service. (e.g., Political hostility, Theft, Absence for 10+ days).

  • Internal Objection: You have 7 days to object to the Disciplinary Board.
  • Lawsuit: If the objection is rejected, you have 60 Days to file a Cancellation Lawsuit in Administrative Court.
