What is a Bounced Check?
A check is considered “bounced” or “dishonored” if, upon presentation to the bank within the legal submission period, there are insufficient funds in the issuer’s account to cover the amount. The bank then stamps the back of the check with a “dishonored” (karşılıksızdır) seal.
Critical Time Limit: The check must be presented to the bank within 10 days if issued and payable in the same city, or 1 month if payable in a different city.
Step 1: Enforcement Proceedings (İcra Takibi)
Once the check is stamped by the bank, it becomes a definitive evidence of debt. The creditor can initiate Specific Enforcement Proceedings for Bills of Exchange (Kambiyo Senetlerine Özgü Haciz Yolu).
- Payment Order: The Enforcement Office sends a payment order to the debtor.
- 5-Day Objection Period: The debtor has only 5 days to object to the signature or the debt.
- 10-Day Payment Period: If no objection is made, the debtor must pay the full amount within 10 days.
- Seizure (Haciz): If payment is not made, the creditor can request the seizure of the debtor’s assets (bank accounts, real estate, vehicles).
Step 2: Criminal Complaint (Check Ban)
Under Law No. 5941 on Checks, issuing a bounced check is also a crime. While imprisonment for debt is generally abolished, checks are an exception.
The Penalty
If the debt remains unpaid, the creditor can file a complaint with the Enforcement Criminal Court (İcra Ceza Mahkemesi). The court can impose a judicial fine. If this fine is not paid, it is converted into a prison sentence (up to 1500 days).
Check Ban
Additionally, the court imposes a ban on the debtor from issuing checks and opening check accounts. This is a severe commercial sanction.
