In the brutal arena of free markets, competition is encouraged, but it must be “honest.” When a business tries to gain an advantage not through better quality or price, but through deception, free-riding, or denigrating rivals, it crosses the line into Unfair Competition (Haksız Rekabet).

  4. Poaching Employees: Systematically hiring all key staff of a competitor to steal trade secrets or paralyze their business.
  5. Breach of Contract: Inducing a supplier or customer to break their valid contract with a competitor.

Lawsuits and Remedies

If you are a victim of Unfair Competition, you can file:

  • Declaratory Lawsuit (Tespit Davası): Court confirms the act is unfair.
  • Cessation Lawsuit (Men Davası): Stopping the ongoing act immediately (e.g., stopping the airing of a commercial).
  • Elimination Lawsuit (Ref Davası): Removing the material results (destructive seizure of fake goods, erasing the sign).
  • Compensation: Material and Moral Damages.

Criminal Liability

Unfair competition is not just a commercial tort; it’s a crime.

  • Penalty: Imprisonment up to 2 years.
  • Unlike typical patent disputes, intentional unfair competition (like knowingly selling confusingly similar goods) can land the director in jail.
