Understanding Alimony (Nafaka)

In Turkey, “Alimony” is not a single concept. It changes depending on the stage of the divorce and who receives it.

1. Temporary Alimony (Tedbir Nafakası)

When: From the moment the divorce lawsuit is filed until the final verdict. Purpose: To prevent the financially weaker spouse and children from financial hardship while the long court battle (2-3 years) continues.

No Fault Required

Even if the cheating spouse is the one asking for it, they can get Temporary Alimony during the trial (as guilt is not yet proven). It stops automatically when the divorce is finalized.

2. Poverty Alimony (Yoksulluk Nafakası)

When: After the divorce is finalized. For Whom: The Spouse (Wife OR Husband). Purpose: To ensure the spouse does not fall into poverty due to divorce.

Conditions:

  1. Fault Rule: The receiver must be Less Faulty (or equal) than the payer.

    If the wife is severely at fault (e.g., she was violent), she gets ZERO alimony.

  2. Poverty: The receiver must be unable to support themselves. (Rich spouses don’t get this).
  3. Indefinite: It is usually awarded “Indefinitely” (Süresiz), not just for a few years.

3. Child Support / Affiliate Alimony (İştirak Nafakası)

When: After the divorce is finalized. For Whom: The Children (under the custody of one parent). Purpose: Contribution to education, health, and food costs.

Strictly Mandatory

Fault doesn’t matter here. Even if the mother is totally at fault for the divorce, if she has custody, the father MUST pay for the child’s care.

  • Ends at age 18.
  • Exception: If the child goes to University, it continues as “Aid Alimony” (Yardım Nafakası).

How Much is It?

There is no fixed ”% of salary” rule in Turkey. The judge decides based on:

  • Social Economic Research (SED) Report (Police checks your income, house, car).
  • Needs of the child (Private school vs public).
  • Living standards during marriage.
