The Battle Doesn’t End at Divorce

Getting an alimony decision is step one. Collecting it or keeping it updated with Turkey’s high inflation is step two.

1. Collecting Unpaid Alimony (Enforcement)

If the ex-spouse stops paying:

  1. Execution Proceeding: You open a file at the Execution Office.
  2. Priority: Alimony has 1st Rank priority in salary attachment (it cuts the queue).
  3. Prison Sentence: If they still don’t pay “Current Month” alimony despite the order, you can file a complaint to the Enforcement Court.
    • Result: Up to 3 Months “Coercive Imprisonment” (Tazyik Hapsi). This usually motivates them to pay immediately.

2. Increasing Alimony (Uyarlama Davası)

5 years ago, 500 TL was money. Today, it’s nothing.

  • If your divorce verdict did not have an “Automatic Annual Increase (CPI)” clause, your alimony melts away.
  • Solution: File an “Alimony Increase Lawsuit” (Nafaka Artırım Davası).
  • Argument: “Inflation is 60%, child’s school fees doubled. 500 TL is not enough.”
  • The court will update the amount to current standards.

3. Removing / Cutting Alimony (Kaldırma Davası)

The payer can sue to stop paying Poverty Alimony if:

  1. Remarriage: If the ex-wife marries another man, alimony stops automatically.
  2. Living as Married: If she lives with a boyfriend without marrying (to keep alimony), this is “Dishonorable Life”. You prove it -> Alimony stops.
  3. Getting a Job: If she got a high-paying job and is no longer “poor”, you can sue to remove it. (Minimum wage usually doesn’t count as “wealth”, but a high salary does).

Frequency: You can file for an increase every year if there is a justified reason, but usually, courts expect a significant change in circumstances.
