Heritage law aims to provide justice among heirs. If Muris made big aids to one child and not to other while alive, this imbalance must be removed after death. This is called “Equalization in Inheritance (Return)” in law.

1. Which Gains Are Subject to Equalization?

According to law (TMK Art. 669), unrequited gains legal heirs received deducted from their inheritance shares are returned to estate.

  • Dowry: Large amount of dowry money or goods given while getting married.
  • Establishment Capital: Shop, capital money given to a child to establish business.
  • Saving from Debt: Payment of child’s large debt by father.
  • Real Estate Transfer: Free (grant) title deed transfers.

2. How is Equalization Done?

While sharing inheritance, two options are offered to heir who received goods while alive:

  1. Return in Kind: Returns the good (e.g. House) to estate, inheritance is reshared.
  2. Offset (Counting): Does not give good, but value of good is deducted from inheritance share. (e.g. If received 1 Million house, if their receivable from inheritance is less than 1 million, pays money on top).

3. Way to Escape Equalization (Exemption)

If Muris explicitly said “Do not subject this good to equalization, this is my extra gift” while giving the good while alive (By noting in title deed or will), that good is not subject to equalization. (However Reserved Share rules are still reserved, if it exceeds reserved share it is abated).

Q: Are school expenses subject to equalization? A: No. Reasonable expenses made for education and learning of children are not subject to equalization. However extreme luxury expenses can be subject of discussion.

Q: Are wedding expenses returned? A: Ordinary (suitable for custom) wedding expenses are not subject to equalization. However extremely valuable jewelry attached in wedding or gifted house/car are subject.
