Inheritance sharing in Turkish law is done according to “Group System” (Degree system). While closest relatives of deceased (Muris) exist, distant ones cannot inherit.

1. Inheritance Share of Surviving Spouse

Spouse inherits with every group but share changes.

  • With Children: Spouse takes 1/4 of inheritance, remaining 3/4 goes to children.
  • With Parents (or Siblings): Spouse takes 1/2 of inheritance, remaining 1/2 goes to others.
  • With Grandparents (or their children): Spouse takes 3/4 of inheritance.
  • If No One Else: Spouse takes all of inheritance.

2. First Group: Descendants (Children/Grandchildren)

If Muris has a child, parents or siblings CANNOT inherit (Except spouse).

  • Children share inheritance equally.
  • If there is a deceased child, their share passes to their own children (grandchildren).

3. Second Group: Parents and Siblings

If Muris has no child/grandchild, inheritance goes up to 2nd group.

  • If mother and father are alive, they share inheritance (after deducting spouse’s share) equally. Siblings cannot inherit.
  • When Do Siblings Receive? If mother or father is deceased, their share passes to their own children (i.e. siblings of Muris).

4. Special Situations

  • Adopted Child: Inherits just like biological child.
  • Unofficial Spouse: If there is no official marriage, has no inheritance right (Unless left by will).
  • Divorced Spouse: Cannot be heir. (If they die while divorce case continues and heirs continue the case and prove fault, they cannot be heir either).

Q: Can more property be given to one of the siblings? A: Can sell property while alive, but if violates “Reserved Share” right of other siblings after death, part of that property is taken back with “Abatement Lawsuit”.
