Heritage law grants the person the right to manage their assets as they wish with “Disposition Mortis Causa” (Will) (Except reserved shares). However, will is strictly bound to form conditions. A small mistake can make the will invalid.

1. Official Will (Safest)

Made at Notary (or Justice of Peace) and in the presence of two witnesses.

  • Literate ones arrange by “Reading and signing”, illiterate ones by “Reading out, approving and fingerprinting”.
  • Advantage: No risk of loss, cancellation is very difficult (Since it is an official document).
  • Witness: Witnesses must be literate and not be relatives (spouse, child, sibling cannot be).

2. Handwritten Will (Easiest)

Does not require cost, can be written at home with pen and paper. Conditions:

  1. Must Be Entirely Handwritten: Cannot be written on computer or typewriter and signed only. Must be handwritten from start to finish.
  2. Date: Date of arrangement as Day, Month, Year must definitely be written in handwriting.
  3. Signature: Must have signature at the bottom.

3. Oral Will (Exceptional)

Valid only in extraordinary situations (War, earthquake, severe epidemic, sudden death danger) and when there is no possibility of making official/handwritten will.

  • Muris tells their last wishes to two witnesses. Witnesses immediately write it down and take it to the judge.
  • Loses its effect 1 month after danger passes.
