Severance Pay Calculation Turkey 2026: Employee Rights

In Turkish Labor Law, Severance Pay (Kıdem Tazminatı) is the most sacred right of an employee. It is a lump-sum payment given to you when you leave your job, based on how many years you worked.
However, getting it is not automatic.
- If you resign without a reason -> No Severance.
- If you are fired for stealing (Code 29/Code 46) -> No Severance.
So, how do you secure your money in 2026? What is the new “Severance Ceiling”?
1. Eligibility Conditions
To qualify for Severance Pay, you must satisfy THREE conditions:
- 1 Year Minimum: You must have worked at least 1 full year at the same workplace/employer.
- Not “Fired for Cause”: The employer must NOT have fired you for “Immoral Behaviour” (e.g., theft, harassment, absenteeism).
- Proper Termination:
- The Employer fired you (without valid reason).
- OR You resigned for “Just Cause” (Haklı Neden).
- OR You retired, got married (for women), or went to military service.
2. Calculation Formula (2026)
The formula is simple: Gross Salary x Years Worked.
- Gross Salary: Not just your cash salary! It includes Regular Bonuses, Food Allowance, Transport Allowance, and even Regular Fuel/Child support. This is called “Dressed Gross Salary” (Giydirilmiş Brüt Ücret).
- The Ceiling (Tavan): The government sets a MAXIMUM amount for 1 year of service.
- 2026 Ceiling (Approx): As of January 2026, the ceiling is indexed to the top civil servant salary (estimated at ~55,000 - 60,000 TL).
[!WARNING] High Earner Trap
If you earn 100,000 TL Gross, the calculation is capped at the Ceiling (e.g., 60,000 TL). You do not get severance based on your full 100k salary unless your employment contract explicitly overrides the statutory ceiling (very rare).
3. Can I Resign and Get Paid? (The “Just Cause” Strategy)
Normally, resignation = 0 TL. But under Article 24 of Labor Law 4857, you can resign IMMEDIATELY and get full severance if:
- Salary Not Paid: Even if unpaid for 1 day, or paid “Under the Table” (part bank, part envelope).
- Mobbing: Systematic psychological harassment.
- SGK Fraud: Employer is paying your SGK premiums on Minimum Wage, but your real salary is higher.
- Health Reasons: Working there endangers your life.
- Force Majeure: Factory stops for >1 week.
[!WARNING] Notary Notice is Mandatory
To use this right, you must send a Notary Notice (İhtarname) stating, “I am terminating my contract due to Article 24/II. Pay my severance.” Do not just stop coming to work, or successful employers will fire you for “Absenteeism” and pay nothing.
4. Notice Pay (İhbar Tazminatı)
Unlike Severance, Notice Pay does NOT have a ceiling and does NOT require 1 year work.

Rule: If the employer fires you immediately (without waiting the notice period), they must pay you the salary for that period.

Periods:
- < 6 months work: 2 Weeks salary.
- 6 - 18 months: 4 Weeks.
- 18 months - 3 years: 6 Weeks.

3 years: 8 Weeks.

Note: If YOU resign without giving notice (and without Just Cause), the Employer can demand this money FROM YOU.
5. Mandatory Mediation (Before Court)
Since 2018, you CANNOT sue the employer directly.
- Application: Apply to Mediation Bureau.
- Meeting: Max 3-4 weeks.
- No Agreement? The Mediator issues a “Final Disagreement Report”.
- Lawsuit: You attach this report to your Labor Court petition.
6. The “Code 29 / Code 46” Trap (Theft/Immorality)
Employers sometimes falsely tag your SGK exit code as “Code 46” (Theft, Trust Breach) to avoid paying.
- Consequence: You get no severance, AND you cannot get Unemployment Salary (İşsizlik Maaşı).
- Action: You must file a “Reinstatement” (İşe İade) Lawsuit or “Receivables Lawsuit” to prove the code was false and correct your record.
7. FAQ
1. I worked for 5 years, then resigned because I found a better job. Do I get severance?
NO. Resigning for a “better job” is not a Just Cause. You leave the money on the table.
2. Can women get severance for marriage?
YES. A female employee can resign within 1 Year of her official marriage date and get full severance. (Only applies to women, sadly).
3. What is the Statute of Limitations?
5 Years. You must sue for your severance and other receivables within 5 years of the termination date.
