When Voluntary Recognition Fails

If the biological father says “It’s not my kid” or “I don’t want it”, the Mother (or the Child) has the right to file a Paternity Lawsuit (Babalık Davası).

Who Can File?

  1. The Mother: Can file.
  2. The Child: Can file (even if the mother doesn’t want to). A trustee is appointed for the child.

Statute of Limitations (Deadlines)

This is critical.

  • For the Mother: She must file within 1 Year of the birth.
  • For the Child: The deadline does not start until the child turns 18. After turning 18, the child has 1 Year (until age 19) to file the lawsuit.

The DNA Test Process

The core of the lawsuit is the DNA test.

  • The Family Court refers the parties to the Forensic Medicine Institute (Adli Tıp).
  • Blood/Tissue samples are taken from Mother, Father, and Child.
  • Accuracy: 99.99%.

  • Old Law: It was a problem.
  • New Law: The judge can order police to bring him by force.
