What is Uncontested Divorce?

Uncontested (Agreed) Divorce (Anlaşmalı Boşanma) is the “Express Lane” of Turkish Family Law. If both spouses agree on everything (divorce, custody, money, goods), the judge divorces them in a single hearing, without listening to witnesses or investigating faults.

The 3 Golden Conditions

1. The 1-Year Rule

The marriage must have lasted for at least 1 year.

• Issue: If you have been married for 11 months, you CANNOT file for Uncontested Divorce. You must either wait or file a Contested Divorce (claiming incompatibility).

2. Complete Agreement (No “Buts”)

Spouses must agree on:

• Custody: Who gets the kids?
• Alimony: How much for the spouse? How much for the kids?
• Compensation: Any damages?
• Household Goods: Who takes the TV, the car, the furniture?
• If there is even 1 disagreement (e.g., “We agreed on everything but the car”), the judge rejects the Uncontested Divorce.

3. Personal Appearance in Court

This is unique to Turkey. Even if you have the best Attorney in the world, YOU MUST ATTEND THE HEARING.

• The Judge wants to hear from your own mouth: “Yes, I want to divorce. Yes, this is my signature on the protocol.”
• This is to prevent forced divorces.

The Process Timeline

3. Hearing Date: Usually given for 1-4 weeks later (depending on court workload).
4. The Hearing: Lasts 5 minutes. Judge asks “Do you confirm?”. You say “Yes”.
