With the advancement of technology, “Cyber Crimes” have become a part of our lives. These crimes are regulated with severe penalties in the Turkish Penal Code.

1. Offense of Illegal Access to an IT System (TPC Art. 243)

Entering (hacking) someone else’s email, Facebook, Instagram, or company system without permission is a crime.

  • Penalty: Imprisonment up to 1 year.
  • Example: Guessing a friend’s password and reading their Instagram messages.

2. Blocking, Disrupting the System, Destroying Data (TPC Art. 244)

Infecting a system with a virus, deleting files, crashing a website (DDoS), or altering data.

  • Penalty: Imprisonment from 1 year to 5 years.
  • Aggravated Circumstance: If committed against a bank or public institution system, the penalty is increased by half.

3. Bank or Credit Card Fraud (TPC Art. 245)

Using someone else’s card without consent or producing a fake card (The most severe cyber crime).

  • Penalty: Imprisonment from 3 years to 6 years.
  • Important: If the person stealing the card is a close relative of the cardholder (spouse, child), no penalty is given (Personal Impunity).

Legal Warning: The most important evidence in cyber crimes is the “IP Address”. However, IP addresses alone do not point to the perpetrator; a detailed investigation by the prosecution is required.
