The Digital “Red Line”

In Turkey, “Cyber Crime” is not just for expert hackers. Guessing your girlfriend’s Instagram password and reading her messages is a crime.

1. Illegal Access (TCK 243)

“Entering an information system without authorization.”

  • Scenario: You log in to someone’s Facebook, Email, or Corporate Panel without permission. Even if you don’t change anything, just “entering” and “staying” is enough.
  • Penalty: Up to 1 Year in prison.

2. Blocking or Destroying Systems (TCK 244)

“Hindering the system, corrupting data, sending viruses.”

  • Scenario: DDoS attacks, crypto-locker ransomware, deleting company databases.
  • Penalty: 1 to 5 Years in prison.
  • Aggravated: If done to a Bank or Public Institution (e.g., University), penalty increases by 50%.

3. Credit Card Fraud (TCK 245) - The Heavy One

Stealing credit card info (Phishing) and buying things online.

  • Penalty: 3 to 6 Years in prison + Fine.
  • Strictness: Judges are very harsh on this. It is treated like bank robbery.

How Are You Caught? (IP Logs)

  • Every connection leaves an IP Trace.
  • ISPs (Turk Telekom, Superonline) store logs for years.
  • Police match the “Login IP” of the hacker with the “Home IP” of the suspect.
  • VPN: High-level hackers use VPNs, but police use other methods (device ID fingerprinting, money trail).
