When Can a Title Deed be Cancelled?

In Turkey, the Title Deed (Tapu) is very strong evidence of ownership. However, if the registration is corrupt, it can be cancelled by a court order.

Common Grounds for Lawsuit

1. Muris Muvazaası (Inheritance Evasion)

The most common case. The father “sells” a valuable apartment to his favorite son for a cheap price just before dying, to hide it from his daughters.

  • Reality: It was a fake sale (Sham/Muvazaa). No money really changed hands.
  • Result: The daughters sue. The deed is cancelled, and the property returns to the estate to be shared.

[!WARNING] Bad Faith Required

To cancel the deed, you must prove the buyer acted in “Bad Faith” (knew about the scheme). If the property was sold to a third innocent party, it is harder to get the house back (you might only get money).

2. Incapacity (Ehliyetsizlik)

  • Scenario: An 85-year-old person with Dementia/Alzheimer’s is tricked into selling their house.
  • Result: Since they lacked “Mental Capacity” to sign, the sale is Void (Yok Hükmünde). We get a hospital report retrospectively and cancel the deed.

3. Fraud and Error (Hile ve Hata)

  • If you were deceived about the essential qualities of the land (e.g., told it was zoning for building but it’s a park), you can sue to cancel the sale.

[!CAUTION] 1 Year Deadline

For Fraud and Error cases, you must file the lawsuit within 1 Year of discovering the fraud. If you wait, you lose your right.

4. Family Residence Annotation Violation

  • If the husband sells the “Family Home” without the wife’s consent (even if it’s in his name), the wife can sue to cancel the sale (TCC Art. 194).
