14-Day Right of Withdrawal (Cayma Hakkı) in Online Shopping

The “Distance Contract” Privilege

When you buy something in a physical store, you see it and touch it. When you buy online (Trendyol, Amazon, Hepsiburada), you rely on a photo. Therefore, the law gives you a “Cooling-Off Period” (Cayma Hakkı).

The Rules

1. Duration: 14 Days from the day you receive the goods.
2. Reason: NONE Needed. You don’t have to say “It’s broken”. You can say “I changed my mind” or “I don’t like the color”.
3. Cost: The Seller must refund the Full Price + Original Shipping Cost.
4. Return Shipping: Generally, the Consumer pays the return shipping (under current regulations), UNLESS the product is defective OR the seller didn’t specify the carrier clearly. (Note: Most big marketplaces still cover return shipping to stay competitive).

Can I Return “Opened” Electronics?

YES. (With exceptions).

• Opening the box of a phone/laptop to inspect it does NOT cancel your right.
• You can turn it on, check the screen, and put it back.
• Sim Card Exception: If you insert a Sim Card and “activate” the phone (registering to BTK), usually the return is refused because the device is now “used/second-hand”.

Non-Returnable Items (Exceptions)

1. Custom Made: A suit tailored to your measurements.
2. Perishable: Food, flowers.
3. Hygiene: Underwear, swimsuits, opened cosmetics (lipstick).
4. Digital: Downloaded software, ebook codes.
