Product Liability: Compensation for Damages Caused by Defects

Beyond the Refund

If a $50 hair dryer explodes and burns your hand, giving you back $50 is not justice. You have the right to Compensation (Tazminat) for the additional harm caused.

Types of Damages

1. Material Damages (Maddi Tazminat)

• Medical Expenses: Hospital bills, surgery, medication.
• Lost Wages: If you couldn’t work for 2 weeks due to the injury.
• Property Damage: If a leaking washing machine ruined your expensive parquet floors, the manufacturer pays for the floor too.

2. Moral Damages (Manevi Tazminat)

• Compensation for the pain, suffering, and trauma experienced.
• Example: A bride gets food poisoning from the wedding cake. The catering company must pay not just for the cake, but for ruining the “Happiest Day”.

Who is Liable? (Strict Liability)

Under the Product Safety Law No. 7223, the Manufacturer (or Importer) is liable.

• You do NOT need to prove they were “negligent” or “lazy”.
• You only need to prove:
  1. The product was defective/unsafe.
  2. The damage happened.
  3. The product caused the damage (Causal Link).

Service Liability

This applies to services too (Doctors, Schools, Hotels).

• If a private hospital performs a botched surgery (Defective Service), they owe massive compensation.
• If a shipping company loses your package, they owe compensation (though often limited by contract, which can be challenged).
