Buying a “Brand New” car from a dealer, only to discover a week later that the hood was repainted or the engine is faulty, is a common nightmare. In Turkey, where car prices are astronomically high due to taxes (ÖTV + VAT), consumers are extremely sensitive to even minor defects.

The good news: Turkish Supreme Court rulings in 2026 are heavily on the side of the consumer.


1. “Misliyle Değişim” (Replacement with New)

If a new car has a defect (even a cosmetic one like repainted parts from the factory), you have the right to demand a “Replacement with a Non-Defective Identity” (Ayıpsız Misliyle Değişim).

  • No Stock Defense: Dealers often say “We don’t have that car in stock anymore, let’s give you a refund”. Do Not Accept Refund. A refund usually gives you the invoice price (e.g., 1 Million TL), but the car is now worth 1.5 Million TL due to inflation.
  • Legal Rule: If the exact model is not available, they must provide the Current Equivalent (e.g., the 2026 facelift model). The court compels them to do this.

2. Hidden Defects (Gizli Ayıp)

  • Open Defect: Visible scratches at delivery. You must reject it immediately.
  • Hidden Defect: Engine failure, gearbox issues, or repainted parts discovered later by an expert (Ekspertiz).
  • Time Limit: For consumer sales, the statute of limitations is 2 Years. However, if there was Fraud (hiding the defect), there is no time limit.

3. Second-Hand Car Warranty

If you buy from a corporate dealer (Galerici) with an Authorization Certificate:

  • Mandatory Warranty: They must provide a 3 Month / 5,000 KM warranty on the Engine, Gearbox, Differential, and Electronics for cars under 8 years/160,000 km.
  • Expert Report: Sale is invalid without a TME-certified expert report.
  • Private Sellers: Buying from a private individual (Sahibinden) is risky. Consumer Law does not apply; general Obligations Code applies (harder to prove).

4. The Lawsuit Process

Since cars are expensive (over 186,000 TL):

  1. Mediation: You must first apply to a Mediator.
  2. Consumer Court: If no agreement, file suit.
  3. Expert Examination: The court sends an expert engineer to inspect the car.
  4. Verdict: If the defect is confirmed, the court orders “Replacement and Registration of the New Vehicle”.

[!TIP] Use the Car: You can usually continue driving the defective car during the lawsuit (unless it’s unsafe). When you win, you hand over the old one and get the new one.


Conclusion

In Turkey’s inflation environment, a vehicle is an investment. Defending its value is critical. Do not accept “repair” offers for major defects in a brand-new car. Demand your right to replacement.
