Bag-Kur Premium Debts, Restructuring and Revival (Revitalization)

Bag-Kur premium debts, which are the fearful dream of tradesmen and company partners, both prevent retirement and stop you from receiving health services.

1. Is Bag-Kur Debt Erased? (Freezing Process)

SGK grants the following right to indebted Bag-Kur members in certain periods (with Omnibus Laws): “I erase your debt, but I also erase (Freeze) your days corresponding to it.”

• Meaning, you get rid of the debt but those days do not count in retirement calculation.
• This process is not automatic, application is required when the law is passed.

2. Regaining Frozen Days (Revival)

If you lack days when retirement time comes, you can regain the days you erased in the past by “Revival” (Revitalization).

• Cost: Revival cost is calculated over the current minimum wage at the date of application. (Formerly paid as much as the debt was, now paid from current value, so it is expensive).
• Condition of Paying All: As a rule, partial revival (e.g., “let me revive only 1 year”) does not exist. You are asked to revive the entire erased period (Exceptions can be forced with Court of Cassation decisions).

3. Can Indebted Bag-Kur Member Benefit from Health?

Under normal conditions, a Bag-Kur member (4/b) with more than 60 days of premium debt cannot receive health service in state hospitals (Does not give provision). Their spouse and children cannot either.

• Exception: With the President’s decision, sometimes permission is given as “Those with debt can also be examined until the end of the year”.

4. Restructuring Opportunities

The state regularly issues “Restructuring Law”.

• Advantage: Delay penalties and interests are erased (or updated with D-PPI and reduced).
• Installment: Installments up to 36-48 months.
• Cash Payment: 90% of interest is erased.

Frequently Asked Questions

Q: I am a company partner, can I stop Bag-Kur and become SSK member? A: You cannot be SSK member in your own company (If you are Ltd. Co. partner). However, if you actually work in another workplace, you can be SSK member. In this case, Bag-Kur stops automatically (4/a is superior to 4/b).
